Top Republican Inclined Against Scotus Filibuster

The top Republican on the Senate Judiciary Committee says he’s inclined against using a filibuster to block President Barack Obama’s nominee to succeed retiring Supreme Court Justice David Souter.

Sen. Jeff Sessions of Alabama said a deal among centrist senators four yours ago that averted filibusters against some of former President George W. Bush’s judicial nominees established a “standard” that shouldn’t be discarded except in unusual circumstances. Sessions, however, didn’t entirely rule out a filibuster.

“I think it should not be often used,” he said in an interview Wednesday.

By elevating Alabama Sen. Jeff Sessions to their top spot on the Senate Judiciary Committee, Republicans have selected their chief inquisitor for President Barack Obama’s first Supreme Court nominee: a Southern, white conservative man who has drawn fire for racially insensitive comments in the past.

Democrats like how this is looking.

“Sessions will help galvanize and crystallize why we need a filibuster-proof majority in the Senate,” a Democratic senator, speaking on the condition of anonymity, told POLITICO Tuesday.

Does Souter’s Silence On Hiring Mean He’s Leaving?

The case of the missing law clerks is this spring’s most-watched mystery at the Supreme Court.

It could be, to borrow a page from Sherlock Holmes, the court’s dog that didn’t bark, offering a clue as to the retirement plans of Justice David Souter.

Or perhaps Souter, known for his wry humor, is having a little chuckle at our expense.

He isn’t saying, declining through a court spokeswoman to put the issue to rest.

Either way, eight justices are known to have hired the four law clerks who will work with them in the Supreme Court term that begins in October. Souter appears to be the lone holdout.
